ВИЯВЛЕННЯ ОЗНАК НЕЗАКОННОГО ВИКОРИСТАННЯ ЗНАКА ДЛЯ ТОВАРІВ І ПОСЛУГ, ФІРМОВОГО НАЙМЕНУВАННЯ, КВАЛІФІКОВАНОГО ЗАЗНАЧЕННЯ ПОХОДЖЕННЯ ТОВАРУ В МЕРЕЖІ ІНТЕРНЕТ ШЛЯХОМ ВИКОРИСТАННЯ ІНФОРМАЦІЇ, ОТРИМАНОЇ ПІД ЧАС КОНФІДЕНЦІЙНОГО СПІВРОБІТНИЦТВА

Abstract
The aim of the article is to solve organizational and legal issues of identifing signs of illegal use of a mark for goods and services, company name, qualified indication of the origin of goods on the Internet using information received from a confidential employee. Confidential cooperation greatly increases the efficiency of the tasks of the operational units of the National Police of Ukraine to combat with intellectual property criminal offenses on the Internet. Also in the scientific article we are talking about the fact that a special regulatory legal act that would completely regulate trade through online stores in Ukraine is not present, which complicates the process of counteraction, detection and investigation of criminal offenses in the field of intellectual property on the Internet. The modern development of the world economy is characterized by radical changes in the definition of the directions of economic progress. Today, the main emphasis is shifting to accelerated innovation, the transition to a knowledge-based strategy and intelligence. The basis of such development are the intellectual property of the nation, scientific achievements, the processes of transformation of the results of creative activity into the production of material and spiritual goods. The role of intellectual property in economic development is increasing throughout the world, outpacing the importance of means of production and natural resources. Ensuring the proper protection and protection of intellectual property rights, including the use of the trademark for goods and services, corporate identity, and qualified indication of the origin of goods on the Internet is a multifaceted socio-economic, political and legal phenomenon, which is an integral part of market relations. Today a significant part of the society makes purchases of goods and material assets through the Internet and each year their number increases, for example, through the online stores of Alibaba, Amazon and eBay – products are sold every day for millions of dollars. The above-mentioned fact began actively use offenders, who are engaged in the manufacture and sale of counterfeit products with signs of illegal use of marks for goods and services, branded name, qualified indication of the origin of goods of famous brands in the Internet.
