Abstract
Mediator’s remuneration in civil proceedings The article is devoted to mediator's remuneration in mediation proceedings initiated under a court order. The author refers the Ordinance of the Minister of Justice on remuneration and reimbursable expenses of a mediator in civil proceedings of 20.6.2016. Starting with a summary of the modern concept of mediation in civil and commercial cases covered by the Directive on consumer ADR, the author analyses current Polish civil procedure and focuses on establishing rate of remuneration and reimbursable expenses. Last but not least, he presents his opinion on the most controversial elements of the abovementioned – parties’ non-accession to mediation. In the overview the author indicates a constitutional question and shows three de lege ferenda demands.
