Зміст понять «релігійні споруди», «культові будинки» та «релігійні святині» у контексті чинного КК України / Content of Notions “Religious Buildings”, “Ceremonial Buildings” and “Sanctuaries” within Effective Criminal Code of Ukraine

Abstract

Articles 178 and 179 of the Criminal Code of Ukraine have such specific items related to crime as “religious buildings” (Art. 178 of the Criminal Code of Ukraine), “Ceremonial Buildings” (Art. 178 of the Criminal Code of Ukraine) and “sanctuaries” (Art. 179 of the Criminal Code of Ukraine). Ukrainian legislation does not explain the meaning of these terms. Legal science does not have a unified understanding of such notions as “religious buildings,” “ceremonial buildings” and “sanctuaries”. This situation cannot be normal and results in the fact that the court should identify whether specific objects can be considered religious buildings, ceremonial buildings or sanctuaries. In our opinion, it is necessary to enshrine these definitions in legislation. We do not think that we can propose our own definitions of such notions as “religious buildings,” “ceremonial buildings” and “sanctuaries” because they should be agreed between legal and religious experts taking into account the fact how various religious groups and confessions apply these notions in practice. At the same time, we agree with the argument that it is necessary to regulate the set of features in these definitions such as physical ones (they should be creations of the world which exist irrespective of human conscious and accepted by sense organs), social ones (these creations should fulfill certain functions and valuable functions for religious people), legal ones (these creations should be alien to the guilty person and be owned by a certain subject of property right) etc.
