ABOUT THE NECESSARY ESSENTIAL ELEMENTS OF THE APPLICATION OF THE INSTITUTION OF ACQUISITIVE PRESCRIPTION

Abstract
In this paper questions of the essence and legal content of long-standing possession as a way of acquiring property on someone else’s thing are investigated. The subject composition of persons, who have the right to obtain ownership in the manner indicated is analyzed. The issue of objects that can be acquired into ownership after the possession of them has been studied. The classical doctrinal concepts regarding the components of the long-standing ownership are evaluated from the point of view of their current expediency and effectiveness. The proposals on additional regulatory regulation of the material relations commented are provided.
