Access to public information in Ukraine: problems of “trisyllabic test” usage

Abstract
The author defines main problem issues of specific legislation’s use in Ukrainian information sphere taking into account its branch peculiarity. He establishes the fact, that Ukrainian legislator determines fundamental constituents of information interaction between the state in form of public authorities, persons of different legal statuses and the whole society sufficiently particular. Taking into consideration the circumstance, that every concrete branch needs a special legal regulation, it tries to provide its concretization in sectoral legislative norms of higher legal force and to regulate in detail social relations, which appear as a result of their practical application. In view of the aforesaid, basic approaches to “trisyllabic test” validity’s and advisability’s usage in practice of public authorities, concerned with information of public interest’s access providing, are outlined here. The urgent problems of legitimacy regarding information’s access restriction and information openness of public authorities in Ukraine are actualized in the article.
