Abstract

This work is dedicated to a theme very important – institution of modification of the civil action. Institution of modification of the civil action finds express regulation, but this rule does not state the legal definition nor traces the legal characteristics of this important institution of civil procedural law. In literature, modifying the civil action was defined as the application by which a litigant amended its previous claims. In recent doctrine, shows that the category of the requested amendments to the civil action includes any request by either party changes a request in court that the previously seized court, whether it was a principal claim, one accessory or an incidental.
