ACTUAL PROBLEMS OF IMPLEMENTATION OF THE RIGHT OF AN ATTORNEY TO THE APPEAL WITH ATTORNEY’S REQUEST

Abstract
The article is devoted to the investigation of the implementation of one of the legally established professional rights of advocate, namely the appeal of advocate’s request. It has been found out that the appeal of the request is an important tool of the attorney for the provision of qualified legal assistance; to obtain and collect evidences in the trial; and also for the proper per- formance by an attorney of his professional duties at all. The current regulatory framework has been analyzed, which regulates issues related to the essence, form, content, legal procedure and terms of the advocate’s request with a request to the competent subjects, as well as – with legal responsibility for failure to respond to the advocate’s request, incomplete, untimely provision of such response or provision of unreliable answer. In this article, the author proposes to introduce specific legislative changes aimed at strengthening the mechanism of bringing officials to account for ignoring the advocate’s request, providing an incom- plete or untrue response to it.
