Adaletsizliğin Hükümranlığı

Abstract

Abstract The discussion about justice is neither realized through obtaining a social methodology nor the truth based conceptual analysis, rather the discussion is a result of the loss of truth that means the facts of injustice prior to the ideal one. This article tries to find an attitude against the sovereignty of injustice in neo-capitalist societies that are full of stimuli by making a comparison between the philosophy of law and sociology of law. This comparison stands against injustice that may stem from ignoring conceptual and factual differences; and also this comparison suggests a broader philosophical-sociological approach of justice between theory and praxis for the science of law. Unfortunately, the majority of the people accept the suspicion injustice situation as a permanent situation. The acknowledgement of injustice in discussions has been realised concurrently with the legitimacy of social inequality. Özet Adalet kavramının ne olması gerektiği, hangi kavramlarla bağlantılı olduğu ve hangi yöntemlerle tartışılacağı sosyal bilimciler tarafından yeteri kadar önemsenmemiştir ve onlar sadece adaletsiz durumları tartışma konusu olarak belirlemişlerdir. Bu tartışmalarda kavramın önüne olgusallık geçmiştir ve bu durum hakikatin yitirilmesine yol açmıştır. Bu çalışmada geç kapitalist uyarıcılarla dolu toplumlarda adaletsiz durumlara yönelik tavrın ne olması gerektiğine ilişkin felsefi ve sosyolojik bakış arasında yanıtlar aranacaktır. Böylelikle dikkat çekilmek istenen, kavramsal ve olgusal adaletin farklılıkları göz önüne alınmaksızın hukuk bilimince konu edilmesinin daha büyük adaletsizliklere yol açabileceğidir. Dahası, adaletsizlikten günümüz için kastedilen müphem ancak kalıcı ve yığınlarca kabul edilmiş bir durumdur. Adaletsizliğin tartışma alanında sıradanlaşması toplumdaki eşitsizliğin meşrulaştırılması ile eşzamanlı gerçekleşmiştir.
