ADMINISTRATIVE AND LEGAL REQUIREMENTS IN THE FIELD OF ENVIRONMENTAL PROTECTION OF UKRAINE

Abstract
The article is devoted to the urgent issue – the general characteristic of administrative and legal needs in the field of environmental protection in Ukraine. In particular, it is noted that the problem of improving state policy in the aforementioned sphere now remains on time and one of the top priorities in the agenda of Ukrainian society and the state. The need to expand further scientific research in the environmental sphere prompts its consideration of fundamentally new positions – the object of administrative law (the content of which are relevant social needs) and its derived administrative requirements. Administrative and legal needs play an essential role in administrative relations and are intended to directly influence the formation of the optimal configuration of the respective groups of social relations on the basis of well-defined and objectively existing social needs. The introduction of administrative legal requirements is quite appropriate and justified in conditions where the content of public (public or state) interest, which in turn should be formed on the basis of the relevant social needs, deforms in contemporary Ukrainian realities. Among the pressing administrative and legal requirements in the field of the environment, it is possible to distinguish two blocks of social needs, which should have appropriate legal regulation. The first (static block) is the administrative needs of the organization of the environmental protection system. The second (block of dynamics) – functioning of the system as a whole and its structural (specific) components. In terms of scale, the system of administrative and legal requirements for the protection of the environmental sphere is proposed to be divided into four-level classical schemes – general, generic, specific, and direct legal requirements. Also, an important issue directly related to the administrative-legal needs (interests) in the field of environmental protection, in our opinion, is the system of risks of their deformation, which is proposed to be divided into two groups – the risks of subjective and objective nature. It is stated that the positive prospect of full and timely implementation of key administrative requirements in the field of environmental protection depends on urgent reform (actual replacement) of the current domestic social matrix, which is now characterized by extremely low level of social organization and functioning, and is a major hindrance to the civilization development of Ukraine and its people.
