Administrative penalties imposed on unemployed persons

Abstract

The representatives of the doctrine rarely mention the aspect of imposing specific sanctions on unemployed persons for the infringement of the rules of Polish administrative substantive law. The paper attempts to discusses the aforementioned issue. It also states an analysis—carried out with regard to the provisions of law, views of the doctrine and jurisdiction—of the two crucial and current phenomena which have an economic, legal and social dimension: unemployment and administrative penalties. The publication presents the definition of unemployment and an unemployed person, differentiation of particular types of penalties (criminal penalty, penalty for a minor offence, pecuniary administrative penalty and non-pecuniary administrative penalty). Further considerations have been transferred to the field of legal regulation referring to the rights and obligations of an unemployed person—the Act on the promotion of employment and labour market institutions. The paper attempts to present an overlooked issue of administrative penalties imposed on unemployed persons as well as specific features of the topic.
