АДМІНІСТРАТИВНА ВІДПОВІДАЛЬНІСТЬ ЗА ПОРУШЕННЯ ЗАКОНОДАВСТВА ПРО ХАРЧОВІ ПРОДУКТИ: ОСОБЛИВОСТІ ПРАВОВОГО РЕГУЛЮВАННЯ

Abstract
The article deals with the peculiarities of the legal regulation of administrative responsibility for violation of the legislation on food products. The author emphasizes that such responsibility is provided for in the Code of Ukraine on Administrative Offenses, which applies to individuals, and the Law of Ukraine “On State Control over Compliance with Legislation on Food Products, Feed, Animal By-Products, Animal Health and Welfare”, which refers to market operators who can be both individual entrepreneurs and legal entities. The author focuses attention on this Law, because the legislator for the first time has established and fixed the administrative responsibility of market operators for offenses. In particular, Article 65 of the Law lists the composition of administrative offenses for which such responsibility is provided. They include: violation of hygiene requirements established by the legislation for the production and / or circulation of food products if this causes a threat to human life and / or health; production and / or circulation of food products using unregistered power, if the obligatory state registration thereof is established by law; production, storage of food without obtaining an operation permit for the corresponding capacity, if the obligation to receive it is established by law; failure to comply with the statutory obligation to implement permanent procedures based on the principles of the system of hazard analysis and critical control points (HACCP); the implementation of food products, the labeling of which does not comply with the law, if it causes a threat to human life and / or health; violation of the requirements for traceability provided by the legislation on food products; failure to comply with the obligation to remove or withdraw hazardous food products from circulation; use, sale of unregistered objects of sanitary measures, if the obligatory state registration thereof is established by law; offering for sale or sale of unsuitable food products and others. The author mentions certain shortcomings of the legal regulation of such responsibility.
