AN EXTRAJUDICIAL AVOIDANCE OF INVALID TRANSACTIONS: A FOREIGN EXPERIENCE

Abstract
In the article an extrajudicial avoidance of invalid transactions in European countries (Germany, the Netherlands, the Czech Republic, Estonia, etc.) is studied. The procedure for carrying out such avoidance by sending a relevant application or communication to participants in the transaction or to public authorities is analyzed. The obligatory requisites of the application for avoidance, the content, form, timing and order of presentation are disclosed. Particular attention is paid to cases where a person is deprived of the right to carry out such avoidance. The author also described the legal consequences to which the avoidance of the transaction leads.
