APPLICATION OF “NO EXPROPRIATION”

Abstract
The author analyses the benchmark decisions of international investment tribunals in tax-related disputes regarding application of “no expropriation” legal regime. The author comes to conclusion that foreign investors can effectively protect their rights claiming that implication of tax measures by the state violates “no expropriation” legal regime.
