Abstract
The article deals with the current scientific approaches in the penal law to determine the relationship between law sentenced to imprisonment for humane treatment of the principles of humanism and respect for human rights and freedoms. Formulated the basic gaps in the field of legal regulation of the right to humane treatment of prisoners.
