Audientia episcopalis comme forme d’exercice du gouvernement dans l’Eglise antique. Une relecture de l’expérience d’Augustin

Abstract
Nous nous sommes proposés de relire de manière analytique les deux lois qui ont donné une reconnaissance juridique à la pratique chrétienne de l’audientia episcopalis. Cette approche nous a permis de rester plus proche du texte et surtout de l’intention du législateur ; évidemment, de pouvoir tirer les conclusions les plus logiques qui puissent y être. Se servant d’une praxis déjà régnante au sein de l’Eglise, Constantin en fait une loi, il fait de l’évêque non un arbitre, mais un juge avec de pleins pouvoirs. Ces deux lois semblent diminuer le pouvoir du iudex impérial mais une lecture attentive nous a fait voir qu’au final, il reste celui à qui Constantin demande de veiller à ce que les décisions de l’évêque soient respectées. L’expérience d’Augustin comme juge nous permet de nous rendre compte que malgré tout, l’évêque-juge reste après tout un pasteur, il exerce donc avec le poids de cette responsabilité.
