Being, duty and information – the prospects of naturalistic metaphysics of law.

Abstract

Modern concepts of metaphysics of the law silently accept the disintegration of the world into a sphere of facts (being, spatiotemporal instances, physical states, objective sphere) and „oughts” (norms, ideas, mental states, subjective sphere). The purpose of this article is to outline a different cognitive perspective, closely linked to the results of natural sciences. The opposition of norms and facts, of being and duty, is based on false assumptions. There is another possibility: the rejection of both categories, i.e., both facts and obligations ,and their replacement with the notion of information. This is the simplest way to incorporate jurisprudence into a scientific picture of the world.<br/><br/>
