[b][i]The Legal Situation of the Author of Scientific Work in the Publishing Practice[/i][/b]

Abstract
This article concerns the issue of the legal situation of the author in comparison to the situation of editor (publisher) in the Polish law and also in German and French laws. It provides an analysis of the structure, content and form of the publishing agreement especially on the ground of Polish copyright law and also civil law of contracts. It represents the evaluation of Polish law regulations in historical aspect. The article discusses the mutual rights and duties of parties to a publishing agreement. The analysis of publishing practice leads to the conclusion that the legal situation of the author is very weak in comparison with the powerful position of the publishing company. The purpose of this article is to find a new solution and to express conclusions de lege ferenda to strengthen the status of the author in relation to the publisher.
