CHESS CLOCK: SAVING TIME IN DOMESTIC ARBITRATION

Abstract

Arbitration has become the preferred mode of dispute resolution over the past few years, especially with respect to Commercial disputes. The primary object of the Act is speedy redressal and this was achieved by relaxing the procedural complexities as compared to traditional court systems. However, over time, Arbitration proceedings also began taking long durations thereby frustrating the Object of the Act. One of the reasons why this is so long winded evidence gathering and examination. The Author suggests the adoption of the Chess-Clock Method for evidence gathering, especially in Domestic Arbitrations. In this Method, a fixed amount of time is allotted to the parties and no oral arguments are taken on lapse of that time. This would also help to achieve the target of completion of arbitral proceedings as set out in the Arbitration Amendment Act of 2015.
