Civilian control over judicial power: approaches to the term definition

Abstract
The article examines the content of civilian control over judicial power in the context of rise of civil society role in country’s life and European integration and globalization processes. Attention has been turned to the fact that building of trust to judicial power on the part of community in democratic society is possible through civilian control realization that, in its turn, can become one of urgent measures of judicial power reforming in Ukraine and give a push to efficient judiciary formation. New scientific approaches to the term «civilian control» definition have been analyzed and the author’s definition regarding understanding the essence of such general-theoretical category as «civilian control over judicial power» has been given. It has been determined that in spite of scholars’ attention to «civilian control» category, its official name is still absent today. Law of Ukraine «On democratic civilian control over Military institution and law enforcement agencies» defines only democratic civilian control. It has been concluded that on the way toward Ukraine’s development as an open state, civilian control is an integral part of practical mechanism establishment for judiciary and community cooperation in particular through setting stable and efficient contacts between them.
