Classification of rights, freedoms and obligations of a person in the field of new technologies

Abstract

The article explores the concept and criteria for the classification of rights, freedoms and obligations of a person in the field of new technologies. The author proposes to determine the classification of the rights, freedoms and obligations of a person in the field of emerging technologies as their division into separate groups with the use of a criterion of grouping. The criteria for grouping the kinds of constitutional rights, freedoms and duties of man and citizen in Ukraine, according to the author, this is a different reason by which you can group them and combine into separate species. There are different criteria for classifying the kinds of constitutional rights, freedoms and responsibilities in terms of new technologies. Among these criteria, the author highlights the fundamental rights to: 1) health and life (peace, artificial insemination, surrogacy, ecologically clean environment, the growing of organs from stem cells; 2) information (public, private, secret, etc.); 3) migration (refugees, foreigners, persons without citizenship or dual citizenship, the right of citizens to freedom of movement, free choice of place of residence, the right to leave the territory of the State and at any time to go back, etc). The constitutional right of a person to life can be accomplished with a clear understanding of the beginning and the end of life. The beginning of the life of a person in national law is determined by the moment of childbirth (including premature or artificial). There are other terms that are established at the international and national levels. Yes, the American Convention on human rights of 22 November 1969, 2006 establishes that the right to respect for the life of every person is protected by the law from the moment of conception (art. 4). The legislation of certain countries child protects differently. Modern technologies in medicine allow you to save the prematurely born children. In 10-11 weeks pregnant all the systems of the human body are already fully formed. Therefore, the legislation of many countries protects the life of the unborn child. Thus, in France, a child's life is protected by the laws through the 10 weeks after conception, in Denmark – after 12 weeks, in Sweden – after 20, in many other countries child legally protected only after birth. Offers conclusions and recommendations. The author offers in the Ukrainian legislation to make changes in order to protect a child's life from the moment of conception. In terms of new technologies according to the author's note regarding the law on euthanasia (the right of a person to a decent death).
