CLOSURE OF ADMINISTRATIVE AND DELICT PROCEEDINGS RELATING TO VIOLATION OF BUDGET LEGISLATION

Abstract
The article investigates the grounds for the closure of proceedings in an administrative offense case, stipulated by Article 164-12 of the Code of Ukraine on Administrative Offenses “Violation of Budget Law”. Based on the analysis of judicial practice, the most widespread circumstances, which lead to the closure of administrative and tort proceedings initiated for violation of the budget legislation, are considered to be the termination at the moment of consideration of the case on administrative violation of the time limits for imposition of administrative penalty (Article 7, Article 247 of the Code of Administrative Offenses) and the absence of an event and the composition of the administrative offense (Clause 1 Article 247 KUpAP).
