COMPETITION AS THE BASIS OF THE INITIALIZATION OF INDIVIDUAL LABOR RELATIONS WITH STATE EMPLOYEES

Abstract
Problem setting. The article examines the problematic issues of legal forms of realization right by citizens to civil service and the grounds for the formation of employment legal relations with government employees. The emphasis is made on the fact that the application of the competition in the selection of civil servants improves the quality of public service personnel. The competitive examination is a social and legal method of assessment the applicants; business qualities. It is based on democratic principles: objectivity, publicity and competitiveness. We can analyze the competitive examination and elections as the grounds for the apparition of employment relations. Legal facts are analyzed as constituent elements of the actual composition and as conditions for competitive substitution of public positions. Article’s main body. The author substantiates the provision that the employment contract, the act of appointment, the Oath of the civil servant are also necessary elements of the actual composition. These two legal facts, together with the act of the competition and the employment contract, are included in the actual composition of the competitive substitution of the posts of state employees. All other legal facts - perform a different (no less important role) procedural conditions of the competitive procedure for the replacement of posts. Conclusions and prospects for the development. The legal nature of the act of appointment of a civil servant and the Oath of a civil servant are investigated. The types of competition are considered: a closed competition, a second contest. The concept of the deferred right of the second applicant for a vacancy is analyzed. There is a need to further study the norms regulating the right of citizens to work in public authorities and the practice of their application.
