PROBLEMS OF ORGANIZATIONAL AND LEGAL SUPPORT TO CONTROL THE USE AND PROTECTION OF LAND

Abstract
Problem setting. The beginning of the XXI century. is a period of major reforms in Ukraine. The transition from centralized to decentralized forms of governance characteristic of management in the field of land use and protection. The principal feature of implementation and specific land features state at the present stage are increasingly engaging in the process of local government. In connection with the introduction of the Land Code of Ukraine of 25.10.2001, the decision and its development of a number of regulations it was necessary to clarify certain key provisions of the legislation of Ukraine, which define the powers of local authorities in the field of land use and protection. Analysis of recent researches and publications. The theoretical basis of this research work consists of lawyers: V. I. Andreytseva, V. P. Balezin, Y. O. Vovk, B. V. Erofeev, I. I. Karakash, N. V. Krasnov, P. F. Kulinich, A. M. Miroshnichenko, V. V. Nosik, Y. S. Shemshuchenko. Target of research. The article is an analysis of a number of legal issues related to organizational and legal support to control the use and protection of land. Article’s main body. The functional activity of local government administration in the field of land use and protection has many areas that are constantly changing, filled with new content, taking into account the state land policy. However, the main areas of activity can be identified. It features planned land use and protection, distribution and redistribution of land, economic and land control functions. The assignment of these functions to basic substantiated by the fact that they cover the most important areas of local government management in the field of land use and protection. Also, be aware that the functions of state and local government in the area of land use and protection form the interconnected units subordinate to solving a single task – to ensure the rational use and protection of land. Conclusions and prospects for the development. Public authorities tend to be mainly carried out by the authorities closest to the citizen. Such authorities are the local authorities. These authorities are able to keep balance private and public interests, managing the lands of these territories and most effective control can be achieved on land located in the municipal property, retaining supervisory functions by the state.
