SOME ISSUES OF THE ADMINISTRATIVE AND LEGAL STATUS OF THE POLICE BODIES OF THE ESTONIAN REPUBLIC

Abstract

Problem setting. The article deals with some actual issues of the administrative and legal status of police authorities in general, and of the Estonian Republic in particular, for studying and applying successful experience of foreign countries in order to improve the activities of Ukrainian law enforcement agencies. Target of research. The purpose of the study is on the basis of analysis of theoretical foundations, legislative acts, to investigate the administrative and legal status of the national police of the Estonian Republic. Analysis of recent researches and publications. The following scientists analyze separate aspects of the question in their researches: O. Skakun, V. Kopeichikov, V. Averyanov, S. Kivalov, K. Volynka, D. Pavlov, Y. Bytyak, O. Bandurka, V. Pleshhkin, R. Mulukayev, I. Voronov, S. Gusarov, M. Gutsalyuk, V. Zhuravlev, V. Zakharov, M. Litvinov, A. Manzhay, S. Ovchynskyy, A. Osipenko, Y. Orlov, M. Perepelytsya, O. Pronevych and others. Article’s main body. Taking into consideration the gradual creation of a European law enforcement agency in Ukraine – the National Police – it is appropriate to turn to the experience of the leading countries of the world, the best practices of reforming, and attract international opportunities and tools. In particular, the experience of police building in the Republic of Estonia is very interesting, taking into account the commonality of the historical past, the geographical proximity of this country, the affinity of cultural ties and security interests. The Estonian police were established on March 1, 1991, after the declaration of the Republic of Estonia. Of course, this was supposed to be a completely new structure, quite different from the former Soviet militia. The primary task of this structure was to replace the ideology of the police: from the punitive (force) that existed all the years of Estonia’s stay in the USSR, to a democratic one, which consisted in a new form of cooperation between law enforcement agencies and the population. Thus, the Estonian police appeared at the initial stage of formation and acquisition of initial experience. It should be noted that certain rights and obligations create the proper legal conditions for the effective performance of the professional duties by the police of Estonia. Conclusions and prospects for the development. Analysing the administrative legal and status of the Estonian police and the experience of reforming the general system of the Ministry of Internal Affairs, we can conclude that it is precisely the clear regulation of the actions of police officers, detailed duties, powers and responsibilities, give positive results in the shortest possible time. Certainly, the experience of Estonia deserves attention and can be used to improve the activities and further development of the system of internal affairs of Ukraine in general, and the National Police of Ukraine in particular.
