COMPLIANCE WITH THE PRESUMPTION OF INNOCENCE IN LAW ENFORCEMENT OF UKRAINE ON THE EXAMPLE FOR CRIMINAL RESPONSIBILITY FOR ILLEGAL ENRICHMENT

Abstract
The article is devoted to a number of problematic theoretical and practical is-sues of action of the article of the Criminal Code, which establishes responsibility for illegal enrichment. The author examined its compliance with the principle of the presumption of innocence. Correspondence of the aspects of the norm in practice with the Constitution of Ukraine and international acts has been analyzed. The article also identifies aspects of the action of responsibility for illegal enrichment associated with the social and political conditions prevailing in Ukraine. Specific court cases on the fact of illegal enrichment were highlighted and analyzed. Possible ways of solving the problems connected with violations of the basic principles of law and criminal law by this article of the Criminal Code of Ukraine are provided.
