Concept and legal framework of activity of water-carriage of Ukraine: custom aspect

Abstract

The article is sanctified to the analysis of legal framework of adjusting of activity of the water-carriage in Ukraine, related to international transportations. It is set that in international acts and national legislation a concept "marine transport", "river transport", "water-carriage", "internal water-carriage", are used in parallel. Most widespread in international acts is application of concepts "marine transport", "river transport". It is set that the publishers of international acts from the end of the twentieth century already apply a concept "marine transport" and "internal water-carriage". It is found out, that at the level of doctrine developments a concept "water-carriage" is used, that, in turn, is divided into marine and river and certainly, that a concept "water-carriage" has a right on existence, that unites two varieties-marine and internal (river) water-carriage. With the aim of providing of only terminology it is suggested to make alteration to the legislative and under law acts of Ukraine in relation to application of concepts "marine transport" and "internal water-carriage". Analysis of maintenance of project of Law № 2475а-3 from 16.05.2017 "About an internal water-carriage" allowed to educe errors in relation to application of only terminology, in particular operating to the concepts "internal marine water". It is recommended the corresponding committee of Verkhovna Rada of Ukraine to bring in corresponding changes to the indicated bill in relation to moving away of word "marine" from a concept "internal marine water", that will allow in the future to avoid application of different terminology. It is set that the order of realization of international marine and internal water transportations is well regulated both international (by multilateral, regional and bilateral agreements) and national normative acts. Used classification of international acts on groups in relation to: international marine transportations; internal water transportations.
