CONCUBINAGE: FROM ROMAN LAW TO MODERN TIMES

Abstract

The article investigates concubinage as a special form of marriage, which first emerged in the time of Roman law and was revived in the 21st Century in the family legislation of Ukraine. For a complete and thorough study of this issue we examined the types of marriage by Roman law, ways of marriage and legal implications. Special attention is devoted to the study of the legal institution of concubinage – a marriage between persons that couldn’t enter into a legal marriage in Rome because of different nationality or legal status. Parallel analysis of existing norms of family law governing the marriage, including art. 74 FC of Ukraine concluded its findings inexpediency introduction of actual legal institution of marriage in modern legislation.
