Constitutional law on information distribution as a condition for the formation of an informational civil society

Abstract

The problems of interdependence and convergence of the concepts of «information society» and «civil society» are being studied. In particular, through the prism of the implementation of the constitutional right to disseminate and free circulation of information as the main modeling link in the processes within these phenomena. On the basis of the analysis of political and legal conflicts and direct contrad ictory clashes between the various interests of certain social groups that evolve into sharp forms of conflict, when ignoring the basic foundations of constitutionality, the author argues that the information can be considered only a humanistic society, introducing the legal definition «information legal society». Through the establishment of humanistic and democratic principles, combined with modern information and technological tools, and aimed at the development of a person and a citizen as the highest value, the author considers the creation of «informational civil society» and, as identity, the «civil information society», where only the emphasis determines the most important point. In the first case – the technology that serves the needs of a democratic society of free citizens acquires a greater weight; in the second – society and its needs dominate over the technology, creating a special request for their use at their benefit. However, according to the author, there is no reasonable ground to artificially divide the human society into an «informational» and «a civil» one; since the society is united not only geographically, but also mentally, culturally, religiously or ideologically, and many other types of connections exist, including the family ones and even traditions and beliefs, not to mention the constitutional and legal «bonds», which, in fact, formulate a political nation.
