CONTRACT IN THE FIELD OF INFORMATION RELATIONS: SOME FEATURES OF CIVIL REGULATION

Abstract
The article is devoted to the consideration of сivil aspects of regulation of contractual relations in information sphere, the characteristics of their types and features, the specificity of legal facts, on the basis of which information contractual obligations arise, change and terminate. In the article from the point of legal doctrine the concept of civil law regulation of information relations is grounded, trends and prospects of legal regulation of information obligations in the legislation of Ukraine are determined. The article concludes that the criterion for the determination of contracts in the field of information relations from the other types of civil contracts is the subject of the contract. Contractual information obligations should include the provision of the transfer of information rights or the refusal to provide such a rights to the debtor. The basic concept of understanding the contract in the field of information relations as an operation of two or more parties aimed at the emergence, change or termination of information relationships. The contract is the main reason for the emergence of information obligations. Contracts in the field of information relations are characterized by: a special subject (granting or transfer of ownership of information); a special object that is information as an independent intangible product or as a component of personal non-proprietary rights or as a result of intellectual, creative activity, whch are protected by the system of intellectual property rights; the personal nature of the execution (performance of the obligation is usually carried out by the debtor; involvement of the sub-executors is allowed only with the consent of the creditor); a special form of conclusion (information obligations arise, as a rule, on the basis of written agreements).
