CONTRIBUTION TO THE HOUSEHOLD NON-PROPERTY MINE

Abstract
The article covers the concept of «non-owner real estate» in accordance with the civil law of Ukraine. The main stages of registration of such property by state registrars of the right to own immovable property are analyzed. The solution of global problems in the field of registration of the ownership right to the owner of immovable property is proposed. The urgency of the discussed topic is confirmed not only by the number of questions regarding the procedure for recognizing the immovable property ownerless, for example, the lack of understanding of the notion of the ownerless thing, but also the lack of well-established systematic interaction between the authorities that carry out state registration of rights to real estate and local self-government bodies. It should be emphasized that the property right is inviolable and no one can be unlawfully deprived of this right or limited in its implementation (Article 321 of the Civil Code of Ukraine). The Constitution of Ukraine also guarantees the holder his right, by establishing a norm according to which no one can be illegally deprived of his property otherwise than by a court decision. Analysis of problematic issues related to the registration of non-owner real estate shows the need for additional discussion of legislation governing relations in the relevant field.
