Creation of a danger to life, health of people, or the environment as a result of pollution or damage of lands

Abstract
The article analyzes such a socially dangerous consequence of the crime provided for in Part 1 of Art. 239 of the Criminal Code of Ukraine “Pollution or damage to lands” as creating a real danger of causing harm. It is proved expedient to continue to maintain criminal responsibility for creating a threat to the victim.
