Criminal law aspects of the international system of the protection of cultural heritage in the event of armed conflict

Abstract
The article examines the development of international legislation on the pro- tection of cultural heritage during a military conflict. For thousands of years, cultural values have been severely damaged during various types of hostilities. Since the 19th century, some states have made initial attempts to introduce legal protection of cultural property during military conflicts. The horrific lootings, destruction and damage of cultural property made during the Second World War have led to the adoption of the UNESCO Convention for the Protection of Cultural Property in the Event of Armed Conflict in 1954 (Hague Convention 1954). The adoption of the conven- tion resulted in the establishment of criminal liability for crimes against cultural heritage during a military conflict. However, some military conflicts have shown insufficient level of legal protection of cultural values. Therefore, in 1999, the Second Protocol to Hague convention 1954 was adopt- ed, which is intended to strengthen the legal protection of cultural heritage. It is important for Ukraine to join the Second Protocol and improve the national legislation on criminal liability for encroachment on cultural values in the event of a military conflict.
