Abstract
The article is devoted to the problem of the correlation of rules that are formed in the business practice of participants in trade legal relations. The differences between the custom (usage) and the rules created by the personal practice of specific counterparties are analyzed. The ways of reforming the law of obligations in Ukraine and Poland are proposed.
