DEBATING A SOCIAL CLAUSE IN WTO: A CASE OF SOUTH ASIAN LABOR MIGRANTS IN ARAB WORLD

Abstract

International Labor Organization which is a UN specialized agency has established a comprehensive system of instruments to accommodate the labor rights. Within the context of international trade, a social clause is the integration of seven core ILO labor rights conventions into trade agreements. World Trade Organization is not subject to the ILO’s labor standards and many countries and human rights activists are advocating for including a social clause into the WTO agreements. Whereas, labor importer and some of the labor exporter countries are also not willing a social clause to be added into WTO’s agreements. On the other hand, in the globalized progressive world, with rapid evolution of the generations of the human rights, no one can deny the necessity of a social clause in the WTO rules and disciplines. This paper will highlight the importance of a social clause in the WTO agreements by critically analyzing the case of South Asian labor migrants in the Arab World particularly in UAE. This paper argues that the miserable condition of the South Asian labor urgently demands an addition of the social clause in WTO agreements on normative grounds
