DECISION OF THE INVESTIGATIVE JUDGE FOR PERMISSION TO PERFORM SECRET INVESTIGATIVE (SEARCH) ACTIONS: SOME ISSUES OF LEGAL REGULATION AND ENFORCEMENT

Abstract
The article analyzes the scientific works of domestic scholars of procedural law and the practice of applying the norms of the Criminal Procedure Code of Ukraine regulating the grounds and procedure for conducting unsolicited investigation (search) actions. Spaces that negatively affect both the effectiveness of the relationship between the investigator, the prosecutor and the investigating judge, and at the level of legal protection of participants in criminal proceedings are highlighted. The expediency of theoretical development of this issue for further use in the domestic norm-setting activities is also justified.
