Definition of the soil cover (surface layer) of the lands and its unlawful appropriation: criminal and legal aspects.

Abstract
The article is devoted to the issues of the regulations application on unlawful appropriation of the soil cover caused by the incompatibility of the elements of the crimes provided for in Articles 2391, and 2392 of the Criminal Code of Ukraine and provisions of the land laws. This research gives grounds to substantiate the need for harmonization of the normative regulation of the meaning of the soil cover (surface layer) of the lands and its unlawful appropriation in the current Criminal Law of Ukraine and land laws.
