Disability and Humans Rights: A Theoretical Analysis

Abstract

Since Enlightenment, theories of justice and, in particular, theories of human rights have been based on principles which are excludable for people with disabilities. The exclusion has not been resolved by contemporary theories of justice. A profound review of some basic assumptions is required to get a full and sound theory of human rights including people with disabilities in equal terms. The inclusion of people with disabilities is an urgent theoretical challenge which must be face in order to perform a sound reform of rules in legal practice.
