ДО ПИТАННЯ ПРО ВЗАЄМОВПЛИВИ ПРАВ ЛЮДИНИ ТА ЇЇ ПОТРЕБ THE QUESTION OF MUTUAL INFLUENCE OF HUMAN RIGHTS AND THEIR NEEDS

Abstract
Розкрито основні наукові підходи до понять «права людини» та «людські потреби», а також проаналізовано взаємовплив прав людини та її потреб. Права людини розглянуто як певні можливості людини, котрі необхідні для її існування та розвитку в конкретно-історичних умовах, об’єктивно зумовлюються досягнутим рівнем розвитку суспільства і забезпечені обов’язками інших людей. Стосовно феномена потреб людини виокремлено такі його інтерпретації як: вимога, дефіцит, нестача чого-небудь в організмі; відображення у свідомості людини того пред- мета, який може її задовольнити; відсутність якогось блага, цінності; об’єктивна необхід- ність для людини; системна реакція людини, в якій потреба постає відображанням у свідомості бажання (потрібності, бажаності чогось у цей момент), що часто переживається як внутрішня напруга та пробуджує психічну активність, пов’язану з цілеспрямованістю. Взаємодія прав людини та її потреб виражається у тому, що перші впливають на формування, існування та задоволення потреби (виконуючи опредметнюючу, орієнтаційну, співвимірну, розподільчу, охоронну та пізнавальну функції стосовно останніх) і, водночас, потреби людини зумовлюють формування її прав, будучи соціальною основою останніх. The article reveals the main scientific approaches to the concepts of «human rights» and «human needs», and analyzes the interrelation between human rights and needs. Human rights are considered as certain human capabilities that are necessary for its existence and development in specific historical conditions, objectively determined by the achieved level of development of society and the secured obligations of other people. Concerning the phenomenon of human needs are identified such its interpretation as: – demand, deficit, lack of anything in the body. The need caused by either the absence of anything that prevents the normal functioning of a person, or an excess of anything, from what the body needs to get rid of. – the reflection in human consciousness of an object, which can satisfy. Here need like is equated to their subject. – the lack of any good values. Being in a state of feeling good, man requires the restoration of broken integrity. The appearance of this good demand will automatically disappear – an objective necessity for man. – system human reaction, in which the need acts as reflection in the consciousness of the desire (necessity, desire something in this moment), is often experienced as internal tension, and arouses mental activity associated with determination. Interaction of human rights and their needs is reflected in the fact that the first affect the formation, existence and satisfaction of needs, performing the function of objectification (its positive characteristics need get only through the encounter with the object («implementator»...) of objectification), the orientation function (the human rights point man, what tools and in what order it should use to satisfy a particular need), the function comparable (because itself valuable thingness is objectively hierarchical, and this hierarchy is required for the way of being a public subject, it must meet it is clear, and a subjective hierarchy of values), the distribution function (law serves primarily as a means of distribution and provision of basic social goods, that is, they serve like a formal source the latest; these rights are, so to speak, «partners» of the satisfaction of vital needs of subjects, «co-organizer» of their livelihoods), security function (the right cause, «project» actions for the safeguard, the protection of values (assets), and in the event of damage, destruction, establish procedures for their rehabilitation) and cognitive function (rights record yourself assessment of objective significance of phenomena, objects for the satisfaction of needs of the subject) in relation to the last and, simultaneously, the needs of man resulted in the formation of her rights,as a social basis of the last.
