ДО ПИТАННЯ ЩОДО ПРИНЦИПІВ СИСТЕМАТИЗАЦІЇ ПІДЗАКОННИХ НОРМАТИВНО-ПРАВОВИХ АКТІВ

Abstract
The article deals with the analysis of scientific publications of domestic and foreign researchers, which is devoted to the principles of systematization of legal acts. The author’s views on the principles of lawmaking, on the principles of streamlining legislation are presented. The article focuses on the definition of such a legal category as the principles of law. The analysis of a number of works devoted to the principles of law-making is carried out. On the basis of this, the division of the principles of law-making into general and special ones was conducted, as well as their general characterization. Further, the article focuses on scientific developments that are devoted to the principles of systematization of normative legal acts, which are defined in the theory of state and law. The approaches of researchers to the list of principles concerning such kind of systematization of legislation as codification are considered. It is noted that the principles of codification are divided into general and special, their characteristics are fulfilled. The attention is focused on the basic principles of law-making activity of state executive authorities, these principles are listed. The attention is drawn to the principles used in the regulation of normative legal acts, the list of these principles is given, as well as their general characteristics. Describing the state of the scientific development of the problem, the author states that during the systematization of subordinate normative legal acts, the principles inherent in the systematization of legislation and the process of law-making. The author expresses his own attitude to the principles of the activity of state executive authorities in the field of law-making. Also, the author’s vision of the list of principles of systematization of normative legal acts, which must be enshrined in the Law “On Legal Acts”.
