El Derecho Indígena, su compatibilidad con los Derechos Fundamentales y su aplicabilidad en el sistema jurídico nacional

Abstract
This work analyzes indigenous law as a fundamental right, recognized by the Constitution of the Republic of Ecuador and by international treaties. An extensive study of the doctrine related to this customary law was carried out, likewise, the legal regulations were analyzed from the current juristic framework based on the reality experienced by people protected by indigenous law and detachment from the execution of the constitutional precepts towards this juridic, the impingement was reflected in the judgments issued by the Constitutional Court from 2014 onwards. Hold in mind that the doctrine issued by this high constitutional interpretation body forms binding jurisprudence. It must be considered that indigenous law, due to its historical and cultural nature, requires the applicability of its legal system in context within the guarantee of an ancestral right, of which Ecuador has the duty to facilitate its application within the national political agenda. The guarantee of the applicability and effectiveness of indigenous law is a responsibility of the institutions of law, of the academy and of society as a whole. Therefore, it is necessary to place the indigenous justice, within the judicial performance of the first instance as constitutional judges and of higher instances.
