ELECTRONIC DECLARATION OF INTENT IN THE LIGHT OF PROJECTED CHANGES TO THE CIVIL CODE

Abstract

The need to discuss the civil-law status of electronic declarations of intent is brought up-to-date by the amendment to the civil code, which is currently drawn up. The amendment is, in turn, the result of the in;uence that has been exerted by the development of new technologies on the way subjects communicate their intent when they perform legal acts. The aim of the publication is to analyze projected legal solutions undertaken, first of all, based on the content of amended regulations pertaining to new forms of legal acts, which change the former regulations in a significant way. The starting point for the discussion is the statement that the issue of electronic declarations of intent remains inseparable with the traditional declaration of intent. Based on such a thesis, the problem issues occurring in the current regulations were presented and then arrangements made were referred to distinguished expressis verbis electronic forms and documented declaration of intent. The trial consequences of new regulations were also discussed.<br/><br/>
