ELECTRONIC EVIDENCE AND ELECTRONIC EVIDENCE MEANS IN BULGARIAN CRIMINAL PROCEDURE

Abstract

This article aims to disclose and argue the need for a novel and expanded understanding of evidence and evidence means in the Criminal Procedure Code of Bulgaria. Based on an analysis of the existing notions of evidence and evidence means, the paper problematizes the lack of appropriate legislation that should regulate the use of electronic evidence and electronic evidence means that have recently permeated and became indelible part of criminal procedures. More specifically, the paper uncovers contradictions and gaps in the extant legislative approach and calls for addressing them. Furthermore, based on the analysis, a number of amendments in the legislation are proposed.
