ENVIRONMENTAL DAMAGE – PROBLEMS OF ASSESSMENT AND REFUNDATION UNDER UKRAINIAN LEGISLATION

Abstract
The article examines the omissions of the definition of “environmental harm” presented in the doctrinal and normative sources, as a factor that hinders a proper assessment of its size in practice. The author offers the contents of the definition of “environmental harm”. The analysis of weaknesses, gaps and contradictions inherent in the legislation of Ukraine in the field of evaluation and compensation of environmental damages performed. The attention is focused on the absence of legal instrumentation design of restorative requirements based on actual size of the caused harm. There is defined the compensatory fundamental vectors, which should be taken into account in the assessment and compensation for environmental damage. There is considered the existing methods of assessment and compensation of environmental damage.
