Estimative conceptions in the activities of cassation administrative court for determining admissibility of judicial decisions, where the case constitutes a significant public interest or paramount importance for the plaintiff

Abstract
The paper outlines the process for implementing procedural discretion by the court of cassation instance in the use of estimative conceptions regarding the admissibility of appeals against court decisions, if the case is of significant public interest or of exceptional importance to the plaintiff. The author has proposed the feasibility of using models of “greedy” local search algorithms and/or the dynamic programming framework to establish “appropriate” criteria for opening or refusal to open cassation proceedings. It has been proved that the court’s assessment of such grounds is possible both under the condition of “positive” and “negative” regulation, in case of obscure content of legal provisions. Procedural discretion has been specified as legitimate in response to simultaneous behavioural patterns, being regulated by procedural law. It is about legitimizing the procedural behaviour of the court and the participants in the case, taking into account the purpose of the law (teleological interpretation) and the relationship between the arguments from the context of the case in accordance with the principle of justice. Attention has been focused on the formulation of approaches of the cassation administrative court on the admissibility of cassation appeal of court decisions. The author has substantiated that in fact a “three-step test” is used to establish a significant public interest or the exceptional value of the case for the complainant, i.e. 1) according to the legitimate goal; 2) on the basis of requirements regarding the quality of law (accessibility, predictability, clear definition of the boundaries of discretionary powers) based on the assessment of the circumstances of the case and statutory regulation; 3) taking into account the principles of proportionality, “the need for a democratic society” in the formulation of the operative part of the court decision.
