Abstract

The article analyzes the possibility of treatment of the Charter of Social Rights of the Council of Europe as a standard specifying the minimum level of protection of social rights in the scale of the European continent. These rights are analyzed as part of European citizenship. Because of the absence of a uniform concept of the Union citizenship, the individual Member States of the European Union do not apply the common model of compliance with the social rights. The effect of this is the intervention of the Union and domestic judicial authorities, since the practical application of the three standards of protection of social rights a limine puts in doubt the equal treatment and gives rise to the suspicion that the provision prohibiting discrimination of the Union citizens on grounds of nationality is violated (article 18(1) TFEU). Claims for social benefits regulated by the European laws are no longer treated by the EU judiciary as privileges which may be satisfied at the sole discretion of the competent public authorities. The article analyzes the following rights regulated in the provisions of the European Social Charter: the right to health care, social assistance, housing and education.<br/><br/>
