Еволюція регламентації спеціальної конфіскації майна в умовах входження України до Європейського співтовариства

Abstract
Article highlights the complex issues of theoretical and practical nature related to the legal regulation of definition “special confiscation as other events of criminal and légal character in criminal legislation of Ukraine. Based on analysіs of regulations of Criminal Code of Ukraine the history of legislative solution of this problem is studied. Focused on positive aspect of last legislative changes and determined perspectives of improving the institute of confiscation of property in criminal law of Ukraine. Освещено комплекс проблемных вопросов теоретического и практического характера по регламентации понятия специальной конфискации, как иной меры уголовно-правового характера в уголовном законодательстве Украины. На основании положений Уголовного Кодекса Украины исследована история законодательного решения обозначенной проблемы. Акцентировано внимание на положительном аспекте последних законодательных изменений, а также определены перспективы по усовершенствованию института конфискации имущества в уголовном праве Украины.
