Fair justice as the objective of activities of the judicial authority

Abstract

The article investigates the main scientific approaches to understanding the nature of “fair justice”, the correlation between this term and the notion of judicial proceedings in the context of activity of the judicial authority. It is noted that the conception of fair justice is formed under the influence of two circumstances: 1) subjective, characterizing the content of the concept of justice at a certain stage of the development of the state, and 2) objective, based on the norms of the legislation in force, specific court practice, which is created by the courts themselves. It is emphasized that the main features of a fair court decision are lawfulness and reasonableness.
