Fair Trial for Children

Abstract
Special characteristics of children from the view of low realization, cognition and self defense are requiring high protection for them. These protections which have considered in international provisions are including proceeding for the accused children or witness. In this paper, the fair trial for child has been discussed in accordance with human rights resources and Iranian law. It can be clearly seen that a consensus regime for children’s protection in trials will being shaped and for consistency with this measures some of national provisions shall be amended. چکیده ویژگیهای خاص کودکان از حیث سطح پایین تمیز، شناخت و توان دفاع از خویش اقتضا دارد تا حمایتهای مضاعفی در مقایسه با بزرگسالان از ایشان به عمل آید. این حمایتها که مورد توجه اسناد بینالمللی متعدد بوده، از جمله دادرسیهایی را شامل میشود که کودکان به عنوان متهم، بزهدیده یا حتی شاهد در آن حضور دارند. در این مقاله، دادرسی منصفانه برای کودکان با توجه به موازین بینالمللی و وضعیت پیشین و فعلی حقوق ایران مورد بررسی قرار میگیرد. بررسیها نشان میدهد که نظامی جهانی برای حمایت از کودکان در رسیدگیهای قضایی در حال شکل گرفتن است و برای هماهنگی با معیارهای بینالمللی در این خصوص، برخی از قوانین و مقررات کشورمان نیاز به اصلاح دارد.
