Financial Copyright Transfer in Clinical Trial Agreements

Abstract
This paper takes up the problems connected with the transfer of financial copyrights to clinical trial results and other work resulting from clinical trial conduct (clinical work). The analysis of legal norms, judicial decisions and opinions expressed in the doctrine enabled identification and initial review of the chosen problems resulting from the following questions: firstly – is transfer of copyrights to future works possible?; secondly – should clinical work be consider as employees’ work?; thirdly – does the transfer of financial copyrights to clinical work require indicating specific exploitation fields in the clinical trial agreement? The legal analysis of the above matters has been made on the basis of the Act on Copyright and Related Rights as of 4th February 1994, also considering the current market standards.<br/><br/>
