ФОНД СОЦІАЛЬНОГО ЗАХИСТУ ІНВАЛІДІВ У СИСТЕМІ БЮДЖЕТНИХ ЦІЛЬОВИХ ФОНДІВ СОЦІАЛЬНОГО ЗАБЕЗПЕЧЕННЯ НАСЕЛЕННЯ УКРАЇНИ: АДМІНІСТРАТИВНО-ПРАВОВА ХАРАКТЕРИСТИКА

Abstract
The research problem for this study is to analyze an actual legal status of the Fund of Social Protection of Disabled Persons in the framework of the system of Ukrainian budget target funds for social purposes in the context of administrative law. A number of themes are considered including the increasing importance of budget target funds in the system of social protection of the population of Ukraine. The author examines various aspects of using the concept of “disabled person” in social studies and its implementation in legal area in accordance with the principles of the comparative law studies and holistic interdisciplinary research methodology as well as system-structural analysis. It is mentioned that the policy of social protection of disabled persons should include new conceptual approaches covering socio-economic, political, legal, organizational, managerial, scientific, methodological, moral, ethical and informational aspects like increase of state guarantees in achieving higher social standards in the material provision of the disabled persons, ensuring active interaction of public organizations etc. This paper is an attempt to present the distinctive list of responsibilities of the above mentioned Fund which performs certain functions of the state on a royalty-free basis, i.e. carries out social protection of a separate category of socially unprotected groups of population. The author highlights noticeable shortcomings in its functioning confirmed by the results of control of the State Service of Ukraine on Labor on employment and employment of disabled persons, herewith most of the violations are connected with the non-fulfillment of the standard of workplaces for the employment of the disabled persons. The findings in this paper can be used for the theoretical framework of Social Security Law and Administrative Law as well as in practice of financing of social security.
